Acceptable Use Policy

This Acceptable Use Policy ("Policy") describes permitted and prohibited uses of the Aqua Pools website at https://aquapoolsaz.com, our landing pages, online forms, appointment-scheduling tools, website chat, email and text-message channels, and any other online service that links to this Policy (collectively, the "Online Services").

This Policy applies to every visitor or person who accesses or uses the Online Services. By accessing or using the Online Services, you agree to comply with this Policy, our Terms of Use, Privacy Policy, and Cookie Policy. If you do not agree, please do not use the Online Services.

1. Permitted Use

You may use the Online Services for lawful, personal, and legitimate purposes, including:

Learning about Aqua Pools and our services;

Requesting information, a consultation, an appointment, an estimate, or a proposal;

Communicating with us regarding a pool, landscape, outdoor-living, construction, remodeling, or related project;

Providing project information, photos, measurements, preferences, or other materials you are authorized to provide;

Managing communications or appointments associated with your inquiry or project; and

Exercising privacy, communication, or other legal rights.

Your use must be consistent with applicable laws, this Policy, and the intended operation of the Online Services.

2. Prohibited Conduct

You may not use, attempt to use, or assist another person in using the Online Services to do any of the following:

Unlawful, Fraudulent, or Deceptive Activity

Violate any applicable federal, state, local, or international law or regulation;

Engage in fraud, deception, misrepresentation, identity theft, or other unlawful conduct;

Impersonate another person or organization, falsely claim an affiliation, or submit another person's information without authorization;

Provide information you know is materially false, misleading, or fraudulent; or

Use the Online Services in connection with stolen property, unlawful funds, or any prohibited transaction.

Harmful or Abusive Conduct

Threaten, harass, stalk, intimidate, exploit, defame, or abuse another person;

Submit content that promotes violence, illegal discrimination, hatred, sexual exploitation, or harm to a person or group;

Send obscene, excessively graphic, malicious, or intentionally disruptive content; or

Use emergency, threatening, or self-harm language to misuse or disrupt non-emergency communication channels. If there is an emergency, contact 911 or the appropriate emergency service.

Security and Technical Misuse

Introduce viruses, malware, malicious code, corrupted files, or other harmful technology;

Attempt to gain unauthorized access to the Online Services, accounts, systems, servers, data, or networks;

Probe, scan, test, defeat, disable, bypass, or interfere with security, authentication, access controls, rate limits, spam controls, cookie controls, or privacy features;

Interfere with, overload, disrupt, damage, or impair the Online Services or another person's use of them;

Use bots, scripts, automated tools, scraping, crawling, or data-mining technology without our prior written permission, except for ordinary indexing by publicly available search engines that follows our published instructions;

Reverse engineer, decompile, disassemble, copy, frame, mirror, or attempt to derive source code or underlying components of the Online Services except where applicable law expressly permits it; or

Circumvent measures designed to prevent unauthorized use, data collection, or access.

Spam and Communication Abuse

Use our forms, chat, scheduling, email, or text-message channels to send spam, bulk solicitations, chain messages, unauthorized advertising, phishing attempts, or repetitive unwanted communications;

Submit automated, duplicate, fake, or intentionally misleading inquiries or appointments;

Manipulate caller identification, email headers, tracking information, referral data, or other communication identifiers;

Attempt to bypass or interfere with an unsubscribe, opt-out, "STOP," privacy, or communication preference; or

Use our contact information or communication channels to build marketing lists or solicit Aqua Pools personnel without permission.

Privacy and Personal Information

Collect, disclose, publish, or misuse another person's personal information without lawful authority;

Submit another person's name, address, telephone number, email address, property information, photos, financial information, or other data without authorization;

Submit Social Security numbers, account passwords, payment-card numbers, medical information, or other sensitive information through general website forms, chat, text messages, or email unless Aqua Pools specifically requests the information through an appropriate secure process; or

Attempt to identify, track, profile, or monitor visitors or Aqua Pools personnel without authorization.

Intellectual Property and Content Misuse

Infringe or misappropriate copyrights, trademarks, trade secrets, privacy rights, publicity rights, or other rights belonging to Aqua Pools or another person;

Copy, reproduce, modify, distribute, sell, license, publicly display, or commercially exploit Website content, photographs, designs, renderings, branding, or materials without authorization;

Remove or alter copyright, trademark, attribution, or proprietary notices; or

Submit content unless you have the right and authority to provide it to us for the purpose intended.

Misuse of Business Information

Use estimates, designs, proposals, renderings, project information, pricing, or communications for fraudulent, unlawful, or misleading purposes;

Misrepresent preliminary information as a final quote, guarantee, permit approval, engineering determination, or binding construction agreement;

Use Aqua Pools' name, license information, branding, project images, or personnel identities to impersonate or falsely represent Aqua Pools; or

Publish knowingly false reviews, fabricate customer experiences, manipulate ratings, or organize coordinated abuse of review or advertising systems.

3. User-Submitted Materials

You are responsible for information and materials you submit through the Online Services. You represent that your submissions are accurate to the best of your knowledge, that you have the right to provide them, and that our receipt and use of them for your inquiry or project will not violate another person's rights or applicable law.

Submitting information does not transfer ownership to Aqua Pools. However, you authorize us and our service providers to host, copy, process, transmit, and use submitted materials as reasonably necessary to respond to your inquiry, evaluate your project, provide requested services, maintain business records, protect the Online Services, and comply with law, subject to our Privacy Policy and applicable agreements.

Do not submit confidential information belonging to a third party unless you are authorized to do so. Submission of information through the Online Services does not by itself create a confidential, fiduciary, contractor-client, or other special relationship.

4. Monitoring and Enforcement

To the extent permitted by law and consistent with our Privacy Policy, Aqua Pools may investigate suspected violations and take reasonable action to protect the Online Services, our business, our customers, and others. Depending on the circumstances, we may:

Reject, restrict, or block access or submissions;

Remove or preserve content or records;

Cancel suspicious or abusive appointments or requests;

Suspend communications through a particular channel;

Report suspected unlawful conduct to service providers, platform operators, regulators, or law-enforcement authorities; or

Pursue available legal remedies.

We are not obligated to monitor every use of the Online Services, and a failure to enforce this Policy in one instance does not waive our right to enforce it later.

5. Security Reporting

If you discover a suspected vulnerability, unauthorized access, or other security concern involving the Online Services, please notify us promptly at [email protected]. Do not exploit the issue, access data that does not belong to you, disrupt the Online Services, publicly disclose the issue before we have had a reasonable opportunity to investigate it, or use the issue to demand payment.

6. Third-Party Services

The Online Services may include or link to services operated by third parties, such as website hosting, forms, chat, scheduling, analytics, social media, advertising, mapping, or financing providers. Your use of a third-party service may also be governed by that provider's terms and policies. Aqua Pools does not control and is not responsible for conduct occurring solely on a third-party service.

7. Changes to This Policy

We may update this Policy to reflect changes in the Online Services, our practices, or applicable requirements. The revised Policy will be posted with a new "Last Updated" date. Your continued use of the Online Services after an update constitutes acceptance of the revised Policy to the extent permitted by law.

8. Relationship to Other Terms

This Policy supplements our Terms of Use, Privacy Policy, Cookie Policy, construction contracts, proposals, and other written agreements. If this Policy conflicts with a signed written agreement governing an Aqua Pools project, the signed agreement will control with respect to that conflict. If this Policy conflicts with the Terms of Use regarding use of the Online Services, the Terms of Use will control.

9. Governing Law

This Policy is governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable law requires otherwise.
